Description du projet ou contexte

The PravoJustice4EU Programme, implemented by Expertise France (EF) with funding from the European Union and the French Ministry for Europe and Foreign Affairs, supports Ukrainian authorities in the continued reform and strengthening of the justice sector.

PravoJustice4EU is structured around two specific objectives: supporting the EU accession process by aligning the Ukrainian justice system with EU standards, including independence, efficiency, quality, integrity, transparency and access to justice; and supporting accountability for core international crimes in line with European and international standards while fostering a holistic transitional justice approach.

Within this framework, the Programme will continue to support comprehensive prosecutorial reform, with the aim of strengthening the independence, impartiality, accountability, quality and efficiency of the prosecution service in line with European standards. In this context, particular importance is attached to improving the system of internal security and preventing corruption and ethical violations within the prosecution authorities.

The Programme’s primary focus is to support Ukraine in fulfilling its EU integration commitments in the area of prosecutorial reform, in particular those set out in the Ukraine Facility Plan, the Interim Benchmarks for Ukraine, the Rule of Law Roadmap, and the commitments arising from the Joint Statement of 11 December 2025 by European Commissioner for Enlargement Marta Kos and Deputy Prime Minister of Ukraine Taras Kachka.

The relevant reform measure under the Rule of Law Roadmap envisages the development and adoption of legislation aimed at strengthening the institutional capacity and effectiveness of the General Inspectorate and improving the system for preventing corruption and ethical violations within the prosecution authorities.

The legislation is expected to address the following areas:

- ensuring that the function of preventing disciplinary and other offenses among prosecutors is fulfilled;

- conducting an independent and objective selection procedure for employees of the Inspectorate General, including verification of their integrity;

- to provide the General Inspectorate with the necessary competence to carry out cooperation with whistleblowers, to ensure their rights and guarantees of protection provided by law;

- providing the necessary institutional powers and material, technical and financial resources;

- granting access to automated information and reference systems, registers and data banks (databases) owned (administered) by public authorities or local self-government bodies;

- expanding the list of information to be checked during secret integrity checks of prosecutors;

- improving the effectiveness of the institution of prosecutorial integrity by delegating to prosecutorial self-governing bodies the authority to determine uniform criteria for assessing the integrity of prosecutors;

- introduction of additional guarantees to ensure the independence of employees of the General Inspectorate (including special dismissal procedure)

The International Expert will provide specialised legal assistance, capacity-development support, comparative expertise, and policy advice to support the development of a comprehensive, coherent, and legally sound legislative framework aimed at achieving these objectives and strengthening the institutional capacity and effectiveness of the General Inspectorate, in line with European standards and under the Programme’s Result A 1.4.2: Support the improving the disciplinary and integrity system for prosecutors   (IBM 23.2.5).
