Description du projet ou contexte

The PravoJustice4EU Program, implemented by Expertise France (EF) with funding from the European Union and the French Ministry for Europe and Foreign Affairs, supports Ukrainian authorities in the continued reform and strengthening of the justice sector.

PravoJustice4EU is structured around two specific objectives: supporting the EU accession process by aligning the Ukrainian justice system with EU standards, including independence, efficiency, quality, integrity, transparency and access to justice; and supporting accountability for core international crimes in line with European and international standards while fostering a holistic transitional justice approach.

Within this framework, the Program will continue to strengthen the institutional capacity of justice-sector bodies contributing to effective rule-of-law implementation, including institutions and professional communities involved in the investigation, prosecution and adjudication of international crimes.

The Project aims to support the Ministry of Justice of Ukraine (MoJ) and other relevant state authorities in strengthening the legal, institutional and procedural framework for coordinating, implementing, monitoring and reporting on Ukraine’s rule of law commitments under the EU accession process, particularly those stemming from the Rule of Law Roadmap (RoL RM), Ukraine Facility Plan (UA Facility), National Program for the Adoption of the EU acquis (NPAA) and interim benchmarks (IBMs) under Chapters 23 and 24.

The further development and integration of Alternative Dispute Resolution (ADR) and mediation represent a critical element of the systemic reform of Ukraine’s justice sector in the context of its European Union integration. Grounded in the goals of the PravoJustice4EU programme to align the Ukrainian justice system with EU standards, the necessity of expanding ADR instruments is justified by the following key strategic frameworks:

• Optimization of the Judiciary: Expanding ADR directly addresses the excessive workload of the court system, which is a cornerstone of the Rule of Law Roadmap. This ensures compliance with reasonable timeframes for other court cases and enhances the overall efficiency and quality of justice.

• Improving the Business Climate: In line with the Ukraine Facility Plan, the development of mediation serves as an effective mechanism for resolving commercial disputes quickly, confidentially, and cost-effectively. This minimizes financial risks for investors, enhances the country's investment attractiveness, and stimulates economic recovery.

• Harmonization with EU Directives: The continuous implementation of mediation ensures full alignment of the national legal framework with European standards, specifically Directive 2008/52/EC on certain aspects of mediation in civil and commercial matters.

• Institutionalization of Practices: In accordance with NPAA objectives, Ukraine must go beyond declaring the availability of ADR by establishing functional mechanisms for quality control of mediation services and professional training for mediators, drawing on the best practices of EU member states.

• Chapter 23 (Judiciary and Fundamental Rights): Broadening access to mediation fulfills the strict criteria for ensuring comprehensive and unimpeded access to justice. A vital step forward is integrating ADR into the Free Legal Aid (FLA) system, making alternative dispute resolution accessible to vulnerable populations.

• Chapter 24 (Justice, Freedom and Security): Introducing restorative justice and mediation in criminal matters (particularly regarding misdemeanors and cases involving juveniles) serves as an essential indicator for humanizing the justice system and reducing recidivism rates.

A major milestone in this process was the adoption of the Law of Ukraine "On Mediation", which laid down the legal foundations for the operation of this institution, defined the core principles of mediation, and established the formal status of a mediator. The next logical phase to guarantee the sustainability of this reform was the creation of a dedicated working body on mediation under the auspices of the Ministry of Justice of Ukraine. This body is designed to ensure a unified state policy, cross-border cooperation, and institutional coordination among the judiciary, the mediator community, and the FLA system.

The International Experts will provide specialized international expertise, advisory support and capacity-development assistance to the MoJ and other relevant state authorities in implementing Alternative Dispute Resolution and mediation as substantial element of the systemic reform of Ukraine’s justice sector in the context of its European Union integration. This will include advising on institutional implementation mechanisms, cross-institutional coordination, monitoring and reporting arrangements; preparing legal opinions, analytical notes and comparative studies; and supporting the development and review of guidelines, methodologies, standard operating procedures, practical tools and training materials, drawing on relevant European standards and best practices.

The assignment will contribute to strengthening institutional capacities and cooperation, improving mechanisms for implementing mediation and ADR, and enhancing the professional knowledge and practical skills of relevant Ukrainian authorities. The further rollout of the ADR and mediation system is no longer an optional tool, but a clear commitment by Ukraine within the EU accession negotiation process. Assessing the effectiveness of this institution and developing recommendations for the Ministry of Justice is a direct indicator of successful delivery under the PravoJustice4EU program. It will also facilitate the exchange of experience between Ukrainian and international stakeholders, promote the application of European best practices, and ensure the integration of international expertise into the Project’s technical assistance and capacity-development activities.
