General objective of the mission

General objective: strengthen the institutional autonomy, financial sustainability and legal clarity of Ukrainian museums by developing targeted compliant amendments to legislation. ,    

Specific objectives of the mission

●    Specific objective 1 (SO1): Legal and regulatory problem mapping: systematically analyze existing bylaws, ministry instructions and statutory constraints governing museum services, IP rights and financial operations.

●   Specific objective 2 (SO2): Targeted legislative and regulatory drafting: formulate concrete, technically sound  amendments to legislation to simplify paid services and establish IPR commercialization frameworks.      

●   Specific objective 3 (SO3): Operational and stakeholder alignment: collaborate directly with the Department of Cultural Heritage and museum practitioners to ensure proposed legal mechanisms are administratively viable and tailored to practical operational realities.

The exact deliverables and timeline will be finalized together with the Ministry of Culture during the inception phase. Indicatively, the assignment is expected to proceed through the following phases:

Expected results

To make sure the reform lasts well beyond this assignment, the technical assistance (TA) places practical, implementable outcomes at its core. The goal is to deliver concrete legal and regulatory changes — whether to the Law of Ukraine "On Museums and Museum Affairs", secondary legislation, or relevant instructions, that open up real additional opportunities for museums, rather than a purely analytical exercise. By focusing on legally sound, administratively workable drafting, the TA ensures these improvements can be adopted and sustained across the museum sector in Ukraine.

At the end of the mission:

●     SO1 – Legal and regulatory problem mapping: existing legislation, bylaws and instructions governing museum paid services and IP rights are reviewed, and key contradictions and administrative barriers are identified.

●    SO2 – Targeted legislative and regulatory drafting: amendments to legislation are developed     , together with explanatory notes.

●      SO3 – Operational and stakeholder alignment: draft proposals are discussed with museum directors, legal staff and the Department of Cultural Heritage, refined based on their input and on lessons from the upcoming study visit (preliminary dates are end of October-beginning of November 2026), and translated into practical guidance for museums.

The National policy & legal expert is expected to deliver:

·     Analytical Report on the Analysis of Foreign and Ukrainian Legislation (Detailed mapping of legal contradictions, bottlenecks, and root causes in museum legislation)

·         Draft amendments to Ukrainian legislation and explanatory notes.    

·         Legal Guidance Note for Museums (Practical manual on applying paid services and IPR licensing legally) .

Coordination

Direct Counterpart: Department of Cultural Heritage, Ministry of Culture of Ukraine.

Reporting: Reports functionally to the Ministry of Culture and mAIDan Ukraine Facility Project Lead.

Institutional Support: Department of Cultural Heritage will provide domain-specific expertise, access to regulatory documentation, and logistical support to organize practitioner consultation meetings.

Expertise France may cover accommodation, transportation, and other ancillary costs in accordance with the applicable Expertise France policies and procedures within missions across Ukraine and in the case of missions abroad.
