Description de la mission

The Ministry of Transport and Communications of the Kyrgyz Republic is considering modernizing weight and dimension control systems (WIM), WIM equipment, automated enforcement processes, and related IT infrastructure. The modernization process may require legal and regulatory analysis related to transport regulation, digital enforcement mechanisms, information systems, data protection, metrological requirements, procurement, as well as PPP or concession mechanisms.
The purpose of engaging a legal consultant is to conduct a legal assessment, identify legal risks, and prepare recommendations to ensure the legal and regulatory sustainability of the weight and dimension control modernization project.

Scope of work

  • Review Kyrgyz Republic legislation on weight and dimension control, motor transport law enforcement, administrative offenses, information technology, personal data, information protection, procurement, concessions and PPPs
  • Analyze regulatory and legal acts on transport control, automated law enforcement, digital evidence, data management and use of information systems
  • Assess legal mechanisms for automated violation detection, evidence generation, administrative processing, notification, appeal and enforcement
  • Assess the legal admissibility and evidentiary value of WIM-generated data, photo/video recordings, ANPR data and digital case files
  • Review legal and regulatory requirements for metrological assurance, certification, calibration, verification and acceptance of measurement results, in coordination with the WIM Expert
  • Assess data protection, cybersecurity, access rights, data retention and interdepartmental data-sharing requirements, in coordination with the local IT expert
  • Identify legal risks tied to PPPs, concessions, outsourcing, data management, delegation of enforcement functions and private-sector operation of system components
  • Prepare recommendations to strengthen the regulatory framework and legal applicability of the modernized system
  • Support preparation or review of draft legal and regulatory documents where necessary
  • Provide legal input to the PPP consultant on procurement strategy, risk allocation, contractual obligations, service level requirements and performance-based mechanisms
  • Participate in meetings, consultations, workshops and validation discussions

Reporting and coordination
Reports to the WIM Expert/Project Coordinator. Participates in the kick-off meeting, coordination meetings every two weeks with the Ministry and Expertise France, technical consultations, stakeholder meetings and validation discussions. Provides intermediate materials at Week 6 for the Interim Report and final legal recommendations at Week 12 for the Final Modernization Report and Implementation Roadmap. All materials submitted electronically in editable format.

Description du projet ou contexte

This assignment falls within the framework of the European Union’s Global Gateway strategy, which aims to strengthen sustainable infrastructure, connectivity, and global cooperation, particularly with partner countries in Africa, Asia, the Balkans, and Latin America.

 

The project “Trans-Caspian Transport Corridor (TCTC) Capacity Development Programme” is being jointly implemented by the German Agency for International Cooperation (GIZ – Gesellschaft für internationale Zusammenarbeit) and the French agency for international technical cooperation (Expertise France – EF).

 

The development of the TCTC is a strategic and transformative project for trade and economic development in the region. It offers an alternative freight transport route, strengthening economic ties between Europe and Central Asia, while promoting greater integration of the participating countries into regional and international trade networks. As such, this initiative aligns closely with the goals of the EU’s Global Gateway strategy for sustainable global connectivity.

 

The project focuses on enhancing connectivity among five Central Asian partner countries (Kazakhstan, Kyrgyzstan, Tajikistan, Turkmenistan, and Uzbekistan) through six main areas of intervention:

Output 1 Enhanced government capacity for development of a simplified, harmonised, paperless and gender-responsive environment for customs and trade in line with international transport and logistics Conventions and relevant EU standards.

Output 2 Improved mechanisms for sustainable transport connections and for interoperability across the various modes of land and sea transport. 

Output 3 Improved government capacity for policy development and implementation relevant for public-private partnerships that incorporate gender principles (PPP).

Output 4 Improved government capacity for gender-responsive reforms and liberalisation of the transport market.

Output 5 Improved tariffs setting mechanisms along the TCTC.

Output 6 Improved capacity of government and transport asset owners for optimisation of transport asset management and related funding mobilisation.

 

While GIZ will implement outputs 1 and 2, EF is responsible of outputs 3 to 6.

 

Expertise France is mobilizing a four-person expert team for this assignment: a WIM Expert/Project Coordinator, who leads the team, defines the technical WIM approach, coordinates the other experts and summarizes results; a Local IT Expert/Systems Integrator, supporting through knowledge of the local IT environment, integration analysis, data flow mapping and implementation continuity; this Legal Consultant role, covering legal and regulatory assessment, digital evidence, data protection and PPP-related legal questions; and a PPP Consultant, covering commercial and financial feasibility, implementation models and risk allocation. This position works under the coordination of the WIM Expert/Project Coordinator and alongside the local IT expert and PPP consultant.

Mandatory requirements

  • Higher legal education
  • At least 3 years of professional experience
  • Experience supporting infrastructure, transport, digitalization, PPP or regulatory reform projects
  • Knowledge of Kyrgyz Republic legislation
  • Experience preparing or reviewing legal and regulatory documents

Desirable requirements

  • Experience supporting automated law enforcement, digitalization or government information systems projects
  • Experience supporting PPP or concession projects
  • Experience in transport regulation, administrative enforcement, digital evidence or metrological legal requirements
  • Experience on international projects
  • Knowledge of English is an advantage
