The AfCFTA is a comprehensive agreement covering the Framework Agreement, Protocols on Trade in Goods, Trade in Services and Dispute Settlement. Within trade in goods, annexes encompass commitments on market access, rules of origin (procedures), customs cooperation, trade facilitation, transit, non-tariff barriers, technical barriers to trade and sanitary and phytosanitary measures. Work is on-going on market access in goods as well as services, as well regulatory chapters in some services sectors.
Implementation of commitments under the AfCFTA is vital for its impact on the ground. Yet to date, there is no record of whether and how commitments under the AfCFTA have been implemented. The various Committees established under the AfCFTA provide a valuable forum for the areas within the auspices of these Committees but do not provide a comprehensive view. Article 4(g) of the AfCFTA Agreements stipulates that State Parties shall “establish and maintain an institutional framework for the implementation and administration of the AfCFTA” and mandates the Council of Ministers, to “ensure effective implementation and enforcement of the Agreement”. (Article 11(3)b of the AfCFTA Agreement).
At the international level, review of national trade policies is a fundamentally important activity of the WTO with respect to the implementation of commitments under WTO Agreements. In the case of AfCFTA, this function is yet to be developed. Implementation review could also act as a ‘soft’ enforcement mechanism and to bring more or continued high level attention to the implementation of the AfCFTA.
A Consultant in Trade Policy Review is being recruited to contribute to the establishment of an implementation review mechanism under the AfCFTA. The Consultant will be integrated into the AfCFTA Secretariat ’s work flow, delivering targeted technical inputs on a need driven basis, informed by an agreed Work Plan developed in close collaboration with the Senior Advisor on Trade Policy Review.

This consultancy is for an initial period of twelve (12) months, upon signature of the contract.
Context
The African Continental Free Trade Area (AfCFTA), signed by 54 of the 55 African countries, seeks to achieve the objective of a continental single market. As of February 2023, 46 member-States have ratified the Agreement. Significant progress has been registered on the negotiations across Phase I (Trade in Goods and Services and dispute settlement) and the recent finalization of Phase II (Competition Policy, Investment and Intellectual Property Rights protocols). The negotiations on the Protocols on Women and Youth in Trade, and the Digital Trade, are envisaged to come on-stream early in 2023, with plans to conclude them during the course of the year.
This landmark agreement offers significant promise for the continent’s transformation, and will open up new economies of scale and create stronger foundations for economic diversification. The AfCFTA is expected to boost intra-African trade, to promote structural transformation and to generate significant employment opportunities in Africa, especially for women and young people. Despite the high political momentum and the strong economic rationale, realising the AfCFTA will require strengthening institutional capacities to complete negotiations and to implement the Agreement, with the active involvement of the private sector and effective cooperation between stakeholders at continental, regional and national level.
Description of the TE TAF
The Team Europe Technical Assistance Facility to support the AfCFTA and Continental Economic Integration (TE TAF) seeks to contribute to the African economic Integration agenda through mainly the realisation of the AfCFTA. It has two specific objectives: (1). Secretariat – with focus on strengthening the institutional capacity to coordinate negotiations, as well as provide oversight on the implementation of the Agreement, and (2). to be an efficient, reactive and flexible mechanism to answer to the needs of the African Union (AfCFTA Secretariat, AUC and some AU Specialized agencies), RECs, AU Member States and other potential continental partners and regional private sector organisations, working on fostering the AfCFTA and economic continental integration.
Funded by the EU, Agence Française de Development, the German Ministry of Development Cooperation (BMZ) and Sweden, the Team Europe Technical Assistance Facility will be implemented by GIZ, Expertise France, and FIAPP under the guidance of the AfCFTA Secretariat. The TE – TAF is implemented through the Project Management Unit (PMU), based at the AfCFTA Secretariat, in Accra, Ghana, whose mandate is to mobilize technical assistance to deliver interventions that foster to enhance implementation of the agreement. Each implementing partner agency (Expertise France, GIZ and FIIAPP) is represented in the PMU.
Qualifications
Academic qualifications: Master’s degree in economics, trade law, environmental policy, international trade, or a related field is required.
Experience: A minimum of 15 years of professional experience working on trade policy and law, or a related area, is required.
Experience working on the African continent and with multilateral institutions is required. Experience with African Regional Economic Communities and World Trade Organization’s negotiations is highly preferable. Experience in data analysis is highly preferred.
Experience in conducting evaluations is desirable.
Language: fluency in English is required, and working knowledge of French is desirable.
