Mission Description

WINWIN Ukrainian Global Innovation Strategy 2030 (Innovation Strategy) has been developed by the Ministry of Digital Transformation (MDT) of Ukraine and approved by the Government of Ukraine. The Innovation Strategy outlines the key vision, goals, priorities, principles and policies in the field of innovation development in Ukraine with the following sectors in focus: Defense technology (DefTech), Medical technologies (MedTech), Biotechnologies (BioTech), Technologies in governance (GovTech), Agricultural technologies (AgroTech), Educational technologies (EdTech), Semiconductor technologies (Semiconductors), Cybersecurity  (Secured Cyber Space), Technologies for green transformation (GreenTech), Immersive technologies (XR), Artificial intelligence (AI), Autonomous unmanned vehicle (AUV), Space technologies (SpaceTech), Fluid Economy.

Under the supervision of the WINWIN Innovation Strategy leadership, the EU4Innovation East Program Director based in Tbilisi (Georgia), the Deputy Program Director, based in Chisinau (Moldova) and the Country Coordinator (Ukraine), the Legal Support Expert will provide comprehensive legal assistance for the development, refinement, and adoption of a legislative framework aimed at promoting the semiconductor technology sector in Ukraine as part of the WINWIN Innovation Strategy 2030.

Working in close cooperation with the Ministry of Digital Transformation of Ukraine, relevant government bodies, and international partners, the expert will support the further drafting, legal alignment, and parliamentary adoption of a package of regulatory acts designed to establish enabling conditions for the semiconductor industry in Ukraine.

The role focuses on legislative drafting, regulatory harmonization, interagency coordination, EU acquis alignment (including the EU Chips Act (Regulation (EU) 2023/1781) and Chips Act 2.0 developments), as well as ensuring compliance with Ukraine’s international obligations, IMF requirements, and European integration commitments.

Objectives and tasks

Working under the supervision of the WINWIN Innovation Strategy leadership, the expert will perform the following tasks:

1. Legal Analysis and Regulatory Assessment

Conduct comprehensive legal analysis and draft legislative acts aimed at stimulating the semiconductor technology sector.

Responsibilities include:

·       analyse draft laws for compliance with:

o   national legislation of Ukraine;

o   EU acquis and European integration obligations;

·       identify legal gaps, inconsistencies, and regulatory risks;

·       prepare legal opinions and recommendations for improvement and harmonisation;

·       propose legally sound regulatory options for implementation of semiconductor sector incentives.

2. Legislative Drafting and Legal Refinement

Support the drafting and legal refinement of a package of legislative and subordinate regulatory acts, including:

·       the Draft Framework Law of Ukraine “On Stimulating the Development of the Semiconductor Technology Sector”, including provisions aligned with EU law on:

o   criteria for granting semiconductor sector entity status;

o   institutional framework and distribution of competences among public authorities;

o   state support and incentive mechanisms for the semiconductor sector;

o   monitoring, compliance, and oversight mechanisms, including supply chain monitoring;

·       related amendments to tax, customs, land, currency regulation, and other legislation, including:

o   tax and customs incentives;

o   land use and infrastructure facilitation mechanisms;

o   simplification of foreign exchange and cross-border operations;

o   additional legal mechanisms supporting investment and industrial development in the semiconductor sector;

·       preparation and legal review of subordinate regulatory acts required for implementation of the legislative framework.

3. Interagency Coordination and Legislative Process Support

Provide legal support throughout the full regulatory lifecycle of the legislative package.

Responsibilities include:

·       support interagency coordination and legal alignment between government institutions; 

·       support public consultations and stakeholder engagement processes;

·       provide legal input during parliamentary consideration in the Verkhovna Rada of Ukraine;

·       ensure consistency of legal wording and legislative coherence across the full regulatory package.

4. EU and International Legal Alignment

Ensure alignment of the semiconductor regulatory framework with EU and international standards.

Responsibilities include:

·       ensure harmonisation with EU semiconductor policy frameworks, including the EU Chips Act and related developments;

·       ensure compliance with Ukraine’s international obligations and commitments under EU integration processes;

·       provide legal analysis related to regulatory convergence and approximation of legislation.

5. Stakeholder and Policy Support

Support legal aspects of policy development and stakeholder engagement processes.

Responsibilities include:

·       provide legal input to policy discussions and technical working groups;

·       support preparation of legal materials for consultations with government institutions and partners;

·       assist in drafting legal components of policy papers, briefs, and explanatory materials.

Expected deliverables 

The Legal Support Expert is expected to contribute to the following outputs:

·       Legal analysis reports covering:

o   compliance with national law, EU acquis, and international obligations;

o   identification of legal risks and gaps;

o   recommendations for regulatory improvement.

·       Draft Law “On Stimulating the Development of the Semiconductor Technology Sector”.

·       Package of related amendments to:

o   tax legislation;

o   customs legislation;

o   land legislation;

o   currency and related regulatory frameworks.

·       Subordinate regulatory acts necessary for implementation of the semiconductor policy framework.

·       Legal support documentation for:

o   interagency coordination processes;

o   public consultations;

o   government approval procedures;

o   parliamentary consideration and adoption process.

Project or context description

EU4Innovation East is a regional project enhancing the competitiveness of the startup ecosystems in five Eastern Partnership (EaP) countries: Armenia, Azerbaijan, Georgia, the Republic of Moldova and Ukraine. At its core is a comprehensive strategy to foster high-performance incubators, expand funding and market opportunities, strengthen community ties and amplify the visibility of EaP startups. Through strategic co-financing, capacity building, regulatory support, and a commitment to gender equality, EU4Innovation East promotes an inclusive and sustainable innovation landscape. By amplifying regional achievements and deepening cross-border connections, the project lays the groundwork for impactful growth.

Required profile

Expert Profile

·       Master’s degree in law, international law, public administration, or related field.

·       Minimum 5 years of professional experience in legislative drafting, regulatory development, or legal advisory roles in public sector or international projects.

Required Knowledge, Experience, Skills, and Abilities

·       Demonstrated experience with Ukrainian legislative and regulatory processes.

·       High understanding of EU law and regulatory approximation processes.

·       Experience working with multi-stakeholder government initiatives.

·       Excellent analytical, drafting, and communication skills.

·       Professional proficiency in Ukrainian and English.

Preferred Qualifications

Experience in one or more of the following areas will be considered an advantage:

·       EU law / EU acquis approximation;

·       industrial policy and innovation regulation;

·       semiconductor, high-tech, or manufacturing sectors;

·       tax, customs, or investment law;

·       international donor or technical assistance programmes;

·       legislative drafting in complex multi-sector reforms.

Additional information

1.    Mission Timeframe

The expert will work on a task order basis and must provide the project with timesheets describing his/her involvement in the implementation of this service.

The expert may also be required to participate in missions organized by Expertise France.
