Objectives and desired results

1)        General objective

To provide senior national expertise and strategic consultations for PravoJustice4EU activities related to enforcement of court decisions and insolvency, supporting the development and implementation of reforms that strengthen institutional capacity, improve effectiveness and efficiency, and contribute to Ukraine’s alignment with European standards and rule-of-law requirements.

 

2)        Specific objectives

• Provide strategic, legal, policy and operational advice to the Program and relevant beneficiaries on reform priorities in enforcement of court decisions and insolvency.

• Plan, consult, implement and provide consultations on Program activities under the relevant thematic work streams in accordance with the approved Programme Work Plan and other programming documents.

• Ensure coherent design and quality control of expert support, analytical products, events, capacity-building activities and other interventions falling under the expert’s area of responsibility.

• Maintain effective consultations for beneficiaries, professional communities and other stakeholders and ensure that Programme support responds to identified institutional and reform needs.

• Contribute to monitoring, reporting, communication, visibility and knowledge-management requirements for the relevant Programme work streams.

 

3)        Anticipated results

• A coherent and operational work stream on enforcement of court decisions and insolvency is planned and implemented in line with the Programme’s objectives and approved work plan.

• Beneficiaries receive timely, high-quality and strategically expertise addressing priority reform needs.

• Short- and medium-term expert inputs and Programme activities are effectively designed, supervised and quality-assured.

• Relevant analytical, policy and technical deliverables are produced in Ukrainian and/or English to the required standard and within agreed timelines.

• Programme management has reliable information on progress, results, risks, dependencies and follow-up actions for the relevant thematic area.

• Consultation, communication and institutional ownership among beneficiaries and stakeholders are strengthened.

 

Description of the assignment

1)        Planned activities

The Senior National Key Expert on Enforcement of Court Decisions and Insolvency shall work under the supervision of the Pillar Team Leader and Programme Team Leader and shall perform the following activities:

• Provide strategic advice and senior-level expertise regarding the design, sequencing and implementation of activities under the relevant thematic work streams.

• Plan, organise, consult, implement and monitor Programme activities in accordance with the Programme Work Plan, logical framework, approved programming documents and management instructions.

• Contribute to the identification of reform priorities, beneficiary needs, implementation risks, dependencies and opportunities for policy, legal, institutional and operational support.

• Design and oversee short-term and mid-term expert missions, including preparation or review of terms of reference, consultation with beneficiaries, quality assurance of deliverables and appropriate follow-up.

• Ensure quality control of analytical notes, legal and policy papers, technical recommendations, reports, presentations and other products prepared under the relevant thematic work streams.

• Draft, review and edit Programme reports, analytical notes, policy papers, briefing materials and other deliverables in English and Ukrainian.

• Contribute to Programme monitoring and reporting, including results achieved, indicators, implementation status, risks, lessons learned and proposed corrective or follow-up measures.

• In consultation with the Project Officer, ensure timely preparation and organisation of Programme events, meetings, consultations, workshops and capacity-building activities, and secure appropriate internal and external follow-up.

• Liaise with beneficiaries, professional communities, civil society, international partners and other relevant stakeholders with regard to implementation of Programme activities and circulation of information concerning thematic deliverables.

• Guide experts, where relevant, in public communication related to thematic activities, including written articles, interviews, presentations and Programme events.

• Contribute to the communication and visibility of the Programme in consultation with the Communications Officer and in accordance with applicable EU and Expertise France requirements.

• Support the Project Officer and Programme management, as required, in addressing financial, logistical, procurement and administrative aspects necessary for timely implementation of activities.

• Participate in internal consultation meetings and provide timely advice to Programme management on implementation challenges, emerging reform needs and required management decisions.

 

2)        Anticipated deliverables

Deliverables:

D1. Inception and strategic planning package. Contributions to the reviewed work plan for the work streams under the expert’s primary responsibility, including means of implementation, implementation retro-planning, expected outputs by activity, and a corresponding strategic planning document outlining planned activities, events, expert missions, procurement needs and other implementation requirements.

D2. Logical framework and monitoring inputs. Review and refinement, in communication with the Pillar Team Leader and Programme management, of relevant logical-framework elements, indicators and baselines for the work streams under the expert’s primary responsibility.

D3. Inception / first Technical Oversight Committee inputs. Substantive contributions to the first Technical Oversight Committee report and/or Inception Report concerning the expert’s thematic area.

D4. Implementation-phase technical and management outputs. Ongoing strategic advice; planning and consultation inputs; reviewed or drafted analytical, legal, policy and technical products; quality assurance of expert missions and deliverables; stakeholder consultation; and documented follow-up actions in accordance with approved monthly or periodic work plans.

D5. Periodic Programme reporting contributions. Substantive contributions to Technical Oversight Committee reports and biannual Progress Reports, including results, indicators, risks, implementation constraints, lessons learned and forward planning for the relevant work streams.

D6. Closing-phase reporting and capitalisation inputs. Substantive contributions to the Programme capitalisation report and Final Report, including achievements, lessons learned, sustainability considerations and recommendations for future support in the areas of enforcement and insolvency.

 

3)        Consultation

The expert shall work under the overall supervision of the PravoJustice4EU Programme Team Leader and the relevant Pillar Team Leader, in close consultation with the Project Officer, Programme management and other experts. The expert shall remain responsible for the quality, consistency and timely submission of outputs within his/her area of responsibility.

The expert shall maintain regular consultation with designated beneficiary focal points and other relevant stakeholders. Any significant implementation issue, delay, dependency or risk affecting Programme activities or expected outputs shall be promptly communicated to Programme management, together with proposed mitigation or follow-up measures.

 

4)        Implementation period

The implementation period, level of effort and detailed schedule shall be established in the expert’s contract and/or approved Programme work plan. Activities may be adjusted by Expertise France depending on Programme needs, beneficiary requests and implementation priorities.

 

5)        Place of performance

The assignment is primarily linked to Programme implementation in Ukraine, including work from the Expertise France / PravoJustice4EU office and participation in meetings and activities with beneficiaries. Remote work or travel, where applicable, shall be subject to prior agreement with Programme management and the applicable contractual and security arrangements.

Assignment reports

The expert shall provide periodic activity and progress reporting in accordance with the contractual modality and Programme procedures. This may include monthly or periodic progress reports and timesheets, as applicable, summarising work performed, tasks completed, documents prepared or reviewed, meetings and consultations attended, outputs produced, issues encountered and proposed next steps. All substantive deliverables shall be submitted to Expertise France for review and acceptance, and consolidated comments shall be addressed within the agreed timeframe.

Practical information

The expert shall comply with all applicable Expertise France contractual, administrative, security, confidentiality, data-protection, ethics, conflict-of-interest and visibility requirements. Participation in travel, events or activities outside the normal place of performance shall be subject to prior approval and applicable Programme procedures.

Working languages are Ukrainian and English. Deliverables shall be prepared in the language requested by Programme management and, where required, in both languages. The level of effort includes preparation, meetings, consultations, analysis, drafting, consultations, presentations and revision of outputs.

Description du projet ou contexte

The PravoJustice4EU Programme, implemented by Expertise France (EF) with funding from the European Union and the French Ministry for Europe and Foreign Affairs, supports Ukrainian authorities in the continued reform and strengthening of the justice sector.

PravoJustice4EU is structured around two specific objectives: supporting the EU accession process by aligning the Ukrainian justice system with EU standards, including independence, efficiency, quality, integrity, transparency and access to justice; and supporting accountability for core international crimes in line with European and international standards while fostering a holistic transitional justice approach.

Within this framework, the Programme will continue to strengthen the institutional capacity of justice-sector bodies contributing to effective rule-of-law implementation, including institutions and professional communities involved in enforcement of court decisions and insolvency.

Although the intensive support provided under Pravo-Justice III in the areas of enforcement of court decisions and insolvency generated substantial results and contributed to notable improvements, the complexity of these sectors and the wider economic and social environment in which they operate require sustained reform efforts. Continued technical assistance is therefore needed to strengthen institutional and professional capacity, improve the effectiveness and efficiency of relevant procedures, support alignment with European standards and good practices, and enhance public and business confidence in the administration of justice. Effective enforcement and insolvency frameworks are also important for legal certainty, economic stability, investment, recovery and sustainable growth.

A. Qualifications and skills:

• Advanced university degree (Master’s degree or PhD) in law from an accredited higher-education institution.

• Excellent legal, policy and analytical drafting skills, with the ability to translate complex reform issues into practical and implementable recommendations.

• Excellent project-management and stakeholder-management skills.

• High degree of initiative, diplomacy and sound judgement, with the ability to solve complex problems in consultation with a diverse range of stakeholders.

• Strong interpersonal and emotional-intelligence skills, including the ability to influence, coach, facilitate cooperation and support change through others.

• Ability to work effectively in complex and demanding institutional environments and to take a proactive, solution-oriented approach to overcoming implementation barriers.

• Fluency in Ukrainian and English, including the ability to draft high-quality professional documents in both languages.

B. General professional experience

• At least 10 years of professional experience in the justice sector, legal reform, public policy, policy steering or another closely relevant field.

• Demonstrated experience in project or programme management, including at senior level.

• At least 5 years of experience with technical-assistance projects funded by the European Union or other international donors.

• Demonstrated ability to work with senior representatives of public institutions, professional bodies, international organisations and other reform stakeholders.

C. Specific professional experience

• Substantial professional knowledge and practical experience relevant to enforcement of court decisions and/or insolvency reform in Ukraine.

• Demonstrated experience in legal, policy, institutional or operational analysis related to enforcement proceedings, the enforcement profession, insolvency, bankruptcy or closely related justice-sector reforms.

• Experience in designing, consultation or delivering technical assistance, reform roadmaps, legal or policy recommendations, institutional capacity-building activities or comparable reform interventions.

• Experience in drafting or reviewing legal, policy, analytical and technical documents for public authorities, international partners or donor-funded programmes.

• Experience in stakeholder consultation, facilitation, workshops, public events or capacity-building activities is an asset.

• Previous experience under Pravo-Justice or another EU-funded justice-sector reform programme in Ukraine is a strong asset.

4. Quality and relevance of the candidate’s profile and demonstrated capacity to deliver the assignment –10%
