Mission description

1)     Planned activities

The Senior Expert on EU Law and Legislative Approximation shall lead the legal quality assurance and legislative approximation workflows, working in close cooperation with Ministry officials, external analytical experts and project leads.

 

Phase 1:

  • Conducting legal evaluations of draft laws and regulatory acts prepared by the Ministry, drafting legal opinions, position papers and concrete amendments to ensure full compliance with the EU acquis.
  • Preparing, analyzing and verifying Concordance Tables between Ukrainian legislation and EU directives/regulations, assessing the accuracy, completeness and quality of transposition.

Phase 2:

  • Tracking the implementation status of measures under the National Programme assigned to the Ministry, identifying legislative gaps, delays and legal risks, as well as recommending solutions.
  • Developing analytical, reporting and briefing materials for Ukraine’s EU accession negotiations, bilateral consultations with the European Commission and interagency coordination meetings.

 

Expert team and working arrangements

The technical assistance will be delivered through a complementary team of three experts:

  • Senior Expert on EU Law and Legislative Approximation (the position of these ToRs) with short term missions and different experts days/month: provides strategic guidance, high-level expertise on EU law and accession processes, peer review and quality assurance of key legal outputs, and targeted support to the Ministry on complex approximation and accession-related issues.
  • Legal Analyst (full time during 6 months): provides day-to-day legal research, analysis and drafting support, including preparation and review of draft legislation, Concordance Tables, legal notes and related analytical materials.
  • Monitoring Expert (full time during 6 months): supports the systematic monitoring of the Ministry's commitments under the National Programme, including progress tracking, consolidation of information, identification of delays and bottlenecks, and preparation of monitoring tools and progress analyses.

The three experts shall operate as one integrated technical assistance team and work closely with the designated Ministry counterparts, the mAIDan Facility Coordinator and the designated mAIDan Project Officer.

The Legal Analyst and Monitoring Expert may be mobilised from the beginning of the assignment to initiate the analytical, drafting and monitoring work. The Senior Expert may be mobilised subsequently and/or intermittently, according to the needs identified by the Ministry and mAIDan, including for strategic guidance, peer review, quality assurance and specific accession-related assignments.

Tasks shall be allocated through individual Purchase Orders according to the nature of the requested support. Purchase Orders may mobilise one or several experts and shall specify the expected contribution and level of effort of each expert concerned.

The experts shall ensure regular coordination, exchange relevant working documents and avoid duplication of tasks. Where several experts contribute to the same output, responsibilities for drafting, review and finalisation shall be clearly agreed at the beginning of the relevant assignment.

Whenever feasible, the assignment will promote peer-to-peer cooperation between Ukrainian experts and practitioners from French or other EU Member State public administrations, with a view to combining in-depth knowledge of the Ukrainian institutional and legislative context with practical EU Member State experience of EU law implementation and accession-related reforms.

The team operates under the overall supervision of the mAIDan Facility Coordinator, with day-to-day coordination ensured by the designated mAIDan Project Officer, in close cooperation with the designated Ministry counterpart(s).

Draft legal outputs and analytical reports produced by the Senior Expert shall be reviewed and validated by the designated Ministry leads prior to final submission or use in formal EU negotiations

Project or context description

Justification of the action

Following Ukraine's EU accession negotiation framework and international commitments, the alignment of national legislation with European Union law (the EU acquis) is a primary strategic priority for the country's recovery, resilience, and integration. Extensive legislative harmonization is required across key EU accession negotiation chapters, requiring strengthened institutional governance and specialized technical legal expertise.

To ensure high-quality, timely and systematic fulfillment of Ukraine's obligations under the National Programme for the Approximation of Ukrainian Legislation to European Union Law, the Ministry requires high-level expert capacity to support its operational tasks, complex legislative drafting, regulatory compliance assessments and negotiation preparations.

Context of the Intervention

Ukraine is implementing comprehensive legislative and institutional reforms as part of its EU integration agenda. Current priorities include legislative approximation with EU standards, legal quality control, and ensuring the timely transposition of EU legal acts into national law.

Given the complexity, scope, and technical nature of these legal reforms, technical assistance is required to conduct comprehensive legal reviews of draft legislation, analyze Concordance Tables, evaluate transposition accuracy, and perform continuous monitoring of the National Programme's execution. The Senior Expert will provide core legal expertise on EU law and legislative approximation, leading legal compliance reviews and supporting interagency and bilateral coordination with the European Commission.

Whenever feasible, the assignment will favour peer-to-peer cooperation between Ukrainian public institutions and practitioners from EU Member State public administrations, in order to facilitate the transfer of practical experience related to EU acquis implementation and accession processes.

Complementarity with Team France Activities

The assignment complements broader donor and international technical assistance support provided to Ukraine’s EU accession process. The Senior Expert on EU Law and Legislative Approximation will work closely with other team members (including the Legal Analyst on the implementation of the EU acquis and the Expert on Monitoring the National Programme) to ensure that all draft legislation, concordance assessments, and negotiation inputs are rigorously evaluated and aligned with the EU acquis.

Required profile

Qualifications and skills

The expert should possess:

  • Master’s degree in Law (LL.M. in European Union Law, International Law, Public Law or a closely related discipline).

Professional experience

The expert should demonstrate:

  • At least 7 years of professional experience in EU law, legislative approximation, EU accession processes and/or implementation of the EU acquis, preferably within or in support of a public administration of an EU Member State or EU institution.
  • Minimum 5 years of demonstrated experience specializing in EU law, legislative approximation and conformity assessment of domestic legislation against the EU acquis.
  • Proven experience in preparing, analyzing and verifying Tables of Concordance and drafting legal compliance opinions.
  • Demonstrated track record in providing legal advisory support to public authorities, ministries or international technical assistance projects on EU integration matters.
  • Prior experience supporting bilateral legal consultations, EU accession negotiations, or institutional reform projects (funded by the EU, IFIs, or international donors) is highly desirable.

Knowledge and competencies

The expert should possess:

  • Deep knowledge of European Union law, EU institutional frameworks and legal harmonization methodologies.
  • Comprehensive understanding of Ukraine’s EU accession framework, the National Programme for Legislative Approximation and domestic legislative processes.
  • Strong legal drafting, analytical and risk-assessment skills.
  • Excellent command of English. Knowledge of Ukrainian would be an asset.

Additional information

Due to the ongoing war in Ukraine and the associated security constraints, the assignment will be performed primarily remotely.

Depending on operational needs, the security situation and the nature of specific assignments, short-term missions to Kyiv may be organised to facilitate direct exchanges with the Ministry, mAIDan Facility team and other relevant stakeholders.

Any mission to Ukraine will be subject to prior agreement with Expertise France, applicable security procedures and assessments, and the security conditions prevailing at the time of travel.

The expert should therefore be available to work remotely and participate in online meetings on a regular basis, while remaining available for occasional in-country missions when required and feasible.
