Description de la mission

Ukraine is implementing comprehensive legislative and institutional reforms as part of its EU integration agenda. Current priorities include legislative approximation with EU standards, legal quality control, and ensuring the timely transposition of EU legal acts into national law.

Given the complexity, scope, and technical nature of these legal reforms, technical assistance is required to conduct comprehensive legal reviews of draft legislation, analyze Concordance Tables, evaluate transposition accuracy and perform continuous monitoring of the National Programme's execution.

The Monitoring Expert will ensure systematic and continuous oversight of the National Programme’s execution within the Ministry’s portfolio.. Working closely with Ministry for Recovery, Infrastructure and Transport counterparts and the mAIDan team, the Monitoring Expert will establish progress-tracking workflows, evaluate the status of legislative approximation tasks and report on operational issues. When mobilised, the Senior Expert will provide complementary strategic and technical guidance on EU accession and approximation-related matters

Objectives and desired results

1)     General objective 

Provide expert legal support to the Ministry for Recovery, Infrastructure and Transport in implementing its responsibilities under the National Programme for the Approximation of Ukrainian Legislation to European Union Law and in drafting high-quality legislation fully aligned with the EU acquis. 

2)     Specific objectives

Phase 1: Baseline mapping, monitoring system design and initial tracking

  • Map all National Programme measures, milestones, and deadlines assigned to the Ministry into an operational monitoring matrix/dashboard.
  • Collect, verify, and consolidate implementation data from relevant internal directorates and subordinate agencies regarding draft legislation and Concordance Tables.
  • Conduct baseline assessments of legal implementation progress and establish early-warning indicators for procedural or administrative delays.
  • Evaluate the completeness and quality of reported progress inputs prior to submission to central coordinating bodies (e.g., Government Office for Coordination of European and Euro-Atlantic Integration - GOCEAI).

Phase 2: Continuous performance evaluation, reporting and issues resolution

  • Prepare regular status reports and analytical dashboards on the progress of legislative approximation under the National Programme.
  • Identify systemic issues (e.g., interagency coordination delays, capacity constraints, legislative backlogs) and draft actionable recommendations for Ministry leadership to accelerate implementation.
  • Support negotiation working groups by tracking compliance with screening benchmarks, roadmap commitments and European Commission recommendations.
  • Maintain data consistency across national tracking systems and support interagency monitoring reviews and donor reporting.

3)     Anticipated results

Results foreseen in relation to phase 1 and 2 of the mission:

  •  Baseline tracking frameworks and relevant monitoring tools are updated and maintained as needed to support ongoing implementation workflows.
  • Relevant progress inputs, implementation data and sectoral updates are regularly compiled, verified and synthesized for operational review.
  • Periodic reporting material and progress summaries are prepared and submitted in accordance with operational requirements.
  • Operational issues are identified and highlighted to the Ministry along with general recommendations.
  • Support is provided to the Ministry as requested.

Description of the assignment

4)     Planned activities

The Monitoring Expert shall work in close cooperation with Ministry officials, the Senior Expert and the Legal Analyst.

The scope of work is intentionally broad to accommodate changing Ministry priorities. Specific task assignments, deliverables and workloads will be defined on an ad-hoc basis via individual Purchase Orders.

The typical activities include:

  • Reviewing, tracking and updating the implementation status of relevant measures under assigned frameworks as requested by the Ministry.
  • Cooperating with relevant internal and external stakeholders to collect, consolidate and analyze operational information and status updates.
  • Preparing general analytical notes and tracking updates on implementation progress and related processes.
  • Carry out other related monitoring, analytical, organizational and reporting tasks assigned via individual Purchase Orders in response to evolving priorities.

5)     Anticipated deliverables

Deliverables will be determined flexibly and issued on a task-by-task basis through individual Purchase Orders. Anticipated deliverable types include:

  • Operational monitoring dashboard/matrix (sectoral roadmap tracking National Programme tasks, deadlines, responsible units and progress status).
  • Monthly monitoring reports (analytical summaries detailing execution rates, completed legislative acts and ongoing commitments).
  • Progress verification notes (technical checks validating that submitted draft laws/regulatory acts match National Programme milestone requirements).

6)     Coordination

Expert team and working arrangements

The technical assistance will be delivered through a complementary team of three experts:

·        Senior Expert on EU Law and Legislative Approximation (the position of these ToRs): provides strategic guidance, high-level expertise on EU law and accession processes, peer review and quality assurance of key legal outputs, and targeted support to the Ministry on complex approximation and accession-related issues.

·        Legal Analyst: provides day-to-day legal research, analysis and drafting support, including preparation and review of draft legislation, Concordance Tables, legal notes and related analytical materials.

·        Monitoring Expert: supports the systematic monitoring of the Ministry's commitments under the National Programme, including progress tracking, consolidation of information, identification of delays and bottlenecks, and preparation of monitoring tools and progress analyses.

The three experts shall operate as one integrated technical assistance team and work closely with the designated Ministry counterparts, the mAIDan Facility Coordinator and the designated mAIDan Project Officer.

The Legal Analyst and Monitoring Expert may be mobilised from the beginning of the assignment to initiate the analytical, drafting and monitoring work. The Senior Expert may be mobilised subsequently and/or intermittently, according to the needs identified by the Ministry and mAIDan, including for strategic guidance, peer review, quality assurance and specific accession-related assignments.

Tasks shall be allocated through individual Purchase Orders according to the nature of the requested support. Purchase Orders may mobilise one or several experts and shall specify the expected contribution and level of effort of each expert concerned.

The experts shall ensure regular coordination, exchange relevant working documents and avoid duplication of tasks. Where several experts contribute to the same output, responsibilities for drafting, review and finalisation shall be clearly agreed at the beginning of the relevant assignment.

Whenever feasible, the assignment will promote peer-to-peer cooperation between Ukrainian experts and practitioners from French or other EU Member State public administrations, with a view to combining in-depth knowledge of the Ukrainian institutional and legislative context with practical EU Member State experience of EU law implementation and accession-related reforms.

The reports and deliverables are to be submitted to and approved by the mAIDan Facility Coordinator, with day-to-day coordination of the experts ensured by the designated mAIDan Project Officer, in close cooperation with the designated Ministry counterpart(s).

Required expertise and profile

Description du projet ou contexte

Following Ukraine's EU accession negotiation framework and international commitments, the alignment of national legislation with European Union law (the EU acquis) is a primary strategic priority for the country's recovery, resilience, and integration. Extensive legislative harmonization is required across key EU accession negotiation chapters, requiring strengthened institutional governance and specialized technical legal expertise.

To ensure high-quality, timely and systematic fulfillment of Ukraine's obligations under the National Program for the Approximation of Ukrainian Legislation to European Union Law, the Ministry requires high-level expert capacity to support its operational tasks, complex legislative drafting, regulatory compliance assessments and negotiation preparations.

Profil souhaité

Qualifications and skills

  • Master's degree in Public Administration, European Studies, Law, International Relations, Economics or related fields.
  • Strong data synthesis, analytical reporting and project tracking capabilities.
  • Excellent command of written and spoken Ukrainian and professional fluency in English.
  • Advanced proficiency in data management and monitoring tools (Excel, tracking databases, dashboarding)

Professional experience

  • At least 5 years of professional experience in policy monitoring, project performance evaluation, public administration or donor-funded project management in Ukraine.
  • Experience in tracking public policy implementation, reform roadmaps or EU integration action plans.
  • Hands-on experience working with government reporting workflows or donor-funded technical assistance projects is highly desirable
  • Experience working directly with Ukrainian central government institutions on EU integration, reform monitoring or legislative approximation would be a strong asset.

Knowledge and competencies

  • Good understanding of the architecture of the National Program for the Approximation of Ukrainian Legislation to EU Law and the EU accession negotiation framework.
  • Clear grasp of government operational procedures, interagency coordination mechanisms and legislative workflows in Ukraine.
  • Familiarity with sector-specific priorities (infrastructure, transport, spatial planning or post-war recovery) is an asset.
