Expertise France, an entity of the French Development Agency (Agence Française de Development, AFD) Group, is the French government’s international technical cooperation agency. Its role is to design and manage donor-funded international cooperation projects in fields such as governance, security, health, education and the environment. The European Union (EU) and the French Government constitute Expertise France’s main donors.

Description du projet ou contexte

The European Union-funded Forestry-Climate Change-Biodiversity (EU-FCCB) Programme for Papua New Guinea aims “to support a development model that reconciles forestry, climate change and biodiversity with sustainable, inclusive and gender-responsive green growth and jobs at national and pilot subnational/community levels”. Its three specific objectives (SOs) are:

-          SO1: “Effective implementation of evidence-based FCCB policies, governance and institutional frameworks”

-          SO2: “Improved FCCB awareness, knowledge, capacities and mobilisation”

-          SO3: “Increased inclusive and gender-responsive green growth”

The EU-FCCB Programme consists of several components, including the national component (33.5 million euros) implemented by Expertise France. This project includes support for a number of PNG-based public sector institutions operating in the FCCB intervention area, support for PNG-based research, education and awareness institutions and support for PNG-based communities, civil society organisations and private sector organisations engaged in conservation, sustainable livelihoods, and sustainable value chain development.

Profil souhaité

 

  • Bachelor of Laws (LLB) degree
  • Candidate must have a current valid practising certificate (RPC) issued by the PNG Law Society
  • At least 3 years of experience in a similar legal role. 5 years recommended.

Informations complémentaires

At the request of the Papua New Guinea Climate Change and Development Authority (CCDA), Expertise France is recruiting a Carbon Markets & REDD+ Legal & Regulatory Expert to support CCDA in the development of its legal / regulatory / guideline framework regarding carbon markets & REDD+.

For reference, Papua New Guinea is actively building a high-integrity, regulated carbon market focused among other things on leveraging its significant rainforest for carbon finance under the Paris Agreement. With the 2024/2025 introduction of the Climate Change (Management) (Carbon Markets) Regulation, the government aims to move toward transparent, sustainable, and high-value carbon trading that directly benefits landowners and local communities.

The Carbon Markets & REDD+ Legal & Regulatory Expert will be a key role in helping to strengthen PNG’s legal / regulatory / guideline framework regarding carbon markets & REDD+, which in turn will help to ensure that this framework provides a strong enabling environment for PNG to take advantage of opportunities in international carbon markets and to support the development of REDD+ initiatives and carbon projects at the national and subnational level.

The Carbon Markets & REDD+ Legal & Regulatory Expert will be hired full-time for a 12-months, renewable, period.

The Carbon Markets & REDD+ Legal & Regulatory Expert will be reporting to the EU-FCCB National Component Technical Coordinator but will be embedded within the Climate Change and Development Authority and working closely on a day-to-day basis with the Mitigation & REDD+ Division and the Legal Unit within CCDA’s Executive Division.

Main tasks:

1.                  Advice on the consolidation of PNG’s carbon markets & REDD+ legal / regulatory / guideline framework

-          Review PNG’s legal/regulatory/guideline framework against a benchmark of other tropical forest countries

-          Assess existing statutory requirements and identify gaps and risks in the Carbon Markets & REDD+ space

-          Review the effectiveness of existing legal/regulatory instruments in the Carbon Markets & REDD+ space

-          Identify priorities and make recommendations in terms of the consolidation of the legal/regulatory framework in the Carbon Markets & REDD+ space

-          Prepare legal opinions as required when it comes to legal / regulatory matters in the Carbon Markets & REDD+ space 

2.     Assistance in the development of legal / regulatory / guideline documents in the carbon markets & REDD+ space

-          Document Drafting: take part in the preparation, drafting, review or negotiation of relevant legal / regulatory / guideline documents in the Carbon Markets & REDD+ space

-          Support consultations with relevant internal and external stakeholders

-          Assist with the review / approval /endorsement / publication of all key documents

-          Assist with the preparation of briefing documents to provide key, targeted, information to stakeholders at different levels.

-          Assist with the successful roll-out and implementation of the legal / regulatory / guideline documents and help address matters that may come up in their application.
