The generation of Waste Electrical and Electronic Equipment (WEEE) is rapidly increasing in Palestine, yet a unified national framework for its environmentally sound management is lacking. The current system is fragmented, with limited enforcement capacity and minimal integration of Extended Producer Responsibility (EPR) principles.
This assignment is a core component of the "Work plan for the Development of a National WEEE-Waste Management Policy and Legal Instructions." The National Legal Expert will be responsible for translating the policy vision into a legally coherent, enforceable set of instructions. This role is crucial for conducting the necessary legal and regulatory gap review, ensuring the new instructions align with national legislation and international obligations (such as the Basel Convention and the EU WEEE Directive), and coordinating the institutional review and final submission process.
Objectives and Expected Results
1. General Objective
To develop a legally coherent, enforceable set of Legal Instructions for WEEE management, aligned with national law and international best practices, and ready for ministerial approval and implementation.
2. Specific Objectives
· Conduct a comprehensive Legal and Regulatory Gap Review to identify legislative requirements and constraints for WEEE and EPR implementation.
· Draft the Legal Instructions, ensuring they are aligned with the National WEEE Policy and technically supported by the National Technical Expert.
· Coordinate the institutional and legal validation process for the draft Legal Instructions.
· Lead the legal preparation and presentation of materials for three national workshops to ensure stakeholder validation and capacity building.
3. Expected Results
· Legal and Regulatory Gap Review Report (O2): A comprehensive report detailing the current legal framework, identifying gaps, and providing recommendations for the new Legal Instructions, benchmarked against international standards.
· Draft Legal Instructions (O4): A legally coherent and enforceable set of instructions supporting licensing, inspection, and EPR implementation.
· Final Legal Instructions (O6): The final, refined version of the Legal Instructions, prepared for submission and endorsement.
· Workshop Materials and Reports: Legal content and presentations for three national workshops (Foundations of EPR, Technical Review, Endorsement and Implementation Readiness).
Description of the Assignment / Key Responsibilities
The National Legal Expert will work under the coordination of the EQA and Expertise France, and in close collaboration with the National Technical Expert.
Key Responsibilities
· Legal Gap Review: Lead the Legal and Regulatory Gap Review (Activity 1.1), analyzing national legislation and international conventions (Basel, EU WEEE Directive) to inform the drafting process.
· Drafting Legal Instructions: Lead the drafting of the Legal Instructions (Activity 2.2), ensuring they are legally sound, enforceable, and incorporate the technical and economic elements of the National WEEE Policy.
· Legal Refinement and Validation: Lead the review and refinement of the Legal Instructions (Activity 3.1) based on institutional and stakeholder feedback and coordinate the final submission (Activity 3.2).
· Policy Support: Provide legal input to the National Technical Expert during the drafting of the National WEEE Policy to ensure legal consistency and enforceability.
· Stakeholder Engagement: Prepare and present legal content for the three national workshops (Activities 1.4, 2.3, 3.4) to facilitate legal review and institutional endorsement.
· Advisory Role (Capacity Building): Provide an advisory role (estimated 5 days total, shared with Technical Expert) to the EQA on the content and destination of any potential future capacity-building activities.
Anticipated Deliverables
The total estimated Level of Effort is 150 working days over a nine-month period.

Qualifications and Skills
· Advanced degree (Master’s or PhD) in Law, Public Law, Environmental Law, or a related field.
· Mandatory Expertise: Proven experience in drafting national legislation, regulations, or legal instructions, preferably in the environmental, waste management, or public policy sector.
· Critical Local Knowledge: Deep knowledge and proven experience in the following areas:
o Principles of Palestinian Legislative Drafting.
o Palestinian Environmental Legislation.
o Palestinian Legal and Judicial System.
o Palestinian Institutional Framework, particularly in the environmental field.
o International Conventions on Hazardous Substances and Wastes.
· Excellent analytical, negotiation, and legal drafting skills.
· Fluency in English and Arabic is required.
General Professional Experience
· At least 8 years of professional experience as a legal advisor, legislative draft, or legal expert, ideally with experience in the public sector or with international development projects.
· Experience in coordinating legal validation processes with government ministries and high-level officials.
Specific Professional Experience
· Demonstrated experience in legal analysis and drafting for complex regulatory environments, particularly those involving technical and economic components (e.g., EPR, licensing, enforcement).
· Proven experience in facilitating multi-stakeholder consultations on legal and regulatory matters.

Evaluation Criteria
Bids will be assessed separately in accordance with the following criteria by awarding a score up to the maximum number of points per criterion as set out below:

The financial score (FS out of a maximum of 30 points) will cover the comparison of the financial offers of all candidates having submitted a conforming bid.
