Mission description

Pursuant to these Terms of Reference, Expertise France intends to contract an International Consultant to conduct a study on P2P transaction enforcement practices in the EU and their applicability in Moldova.

The goal of the mission is to provide sufficient insights into the best practices for P2P trading systems’ setups in the EU, clarifying all the aspects necessary for successful application of P2P electricity trading, and to provide recommendations for its implementation in Moldova, ensuring an operational and sustainable system. The recommendations, inter alia, shall detail all legal/regulatory aspects, which will also serve as a basis for subsequent elaboration of a draft P2P electricity trading contract with mandatory clauses to be approved by the NRA.

Scope of Work:

The international consultant, with the support of local specialists, where appropriate, will be responsible for:

ü  Literature Review and Analysis: Conduct a thorough desktop review of existing publications on P2P electricity trading in the European Union, including regulatory frameworks, market mechanisms and case studies, aiming at:

o   Clarifying the concepts of P2P electricity trading and typical architectures of P2P trading systems;

o   Identifying best EU practices for P2P trading systems’ setups and schemes;

o   Describing, in sufficient details, the operational models, market mechanisms, and inherent legal/regulatory frameworks that enable P2P electricity trading;

o   Providing a list of P2P trading stakeholders and a summary of their roles, obligations and rights.

ü  Regulatory Assessment: Based on the findings of the literature review, conduct an analysis of the current regulatory environment in Moldova, aiming at:

o   Evaluating of the current regulatory framework applicable to P2P electricity trading in Moldova;

o   Comparing the identified best practices for P2P electricity trading with the current state of play and their applicability in Moldova;

o   Providing an overview of the various system issues that could arise during the implementation of P2P trading;

o   Expending in clear terms the current system and regulatory framework gaps that hinder the deployment of P2P trading;

o   Providing recommendations for the implementation of P2P electricity trading, including an overview of the necessary amendments to the legal framework to facilitate it in Moldova;

o   Providing recommendations for the mandatory clauses of the P2P electricity trading contract;

o   Providing a proposal for an implementation roadmap of the P2P electricity trading system in Moldova, including tentative timelines, milestones, and resource requirements.

ü  Stakeholder Consultation: Engage with relevant stakeholders in Moldova, including government bodies, energy companies, and consumer groups, as necessary, to gather insights and validate conclusions.

The estimated workload for the international consultant shall correspond to maximum of 35 man-days.

Mission management arrangements:

The international consultant will report directly to the Team Leader of the Moldovan Green Transition Technical Assistance Facility project and collaborate closely with the delegated representatives of the National Agency for Energy Regulation of the Republic of Moldova. All deliverables must be reviewed and approved by the Team Leader and NRA.

Project or context description

The Agence Française de Développement (AFD) has launched a program of Technical Assistance (TA) to support the Moldovan Government in continuing the energy reform. Expertise France (EF), the French public agency for international technical assistance, was entrusted by the AFD with the implementation of the project. As part of several commitments undertaken by Moldova in pursuit of its accession to the European Union, the country is engaged in an in-depth reform of its energy sector, including operational, financial and structural aspects. The TA aims at supporting the Moldovan authorities for the development of a modern energy legal framework.

In December 2023, amendments to the Law no. 10/2016 on the promotion of the use of energy from renewable sources (henceforth – Renewable Energy Law no. 10/2016) were adopted by the Parliament of the Republic of Moldova. The respective amendments aimed at partial transposition of the Directive (EU) 2018/2001 of the European Parliament and of the Council of 11 December 2018 on the promotion of the use of energy from renewable sources.

The amended Law no. 10/2016 established the responsibility of the National Agency for Energy Regulation of the Republic of Moldova (henceforth – National Regulatory Authority, NRA) to develop and approve the mandatory clauses of the contract for peer-to-peer (P2P) transactions.

However, given the novelty nature of P2P trading arrangements for Moldova and the importance of such transactions in providing renewable energy prosumers with flexibility to generate renewable electricity, store and sell excess production, there has emerged a need for a better understanding of the EU best practices in this regard.

Hence, the NRA requested support from the EF TA project to commission a study on P2P transaction enforcement practices in the EU and their applicability in Moldova. The objective of the study is to identify and document typical architectures of P2P energy trading systems, operational models, market mechanisms, and legal/regulatory frameworks that represent best practices across the EU, enabling effective and efficient P2P trading. Moreover, the study shall provide a comparison of the identified best practices with the current state of play in Moldova and assess their applicability. In addition, it shall offer recommendations for the implementation of P2P electricity trading in Moldova. These recommendations shall provide sufficient insights for the subsequent development of a P2P contract template with mandatory clauses to be approved by the NRA.

In this context, Expertise France, within the framework of the Moldovan Green Transition Technical Assistance Facility project, in supporting the National Agency for Energy Regulation of the Republic of Moldova, seeks to recruit  an expert with strong international experience (henceforth – International Consultant). The expert shall elaborate the study on P2P transaction enforcement practices in the EU and their applicability in Moldova, as described above. Throughout the whole process of study elaboration, the International Consultant will be supported by a delegated NRA specialist and a representative from the TA Project Implementation Unit (PIU)– the Senior expert in EU Energy policies and Renewable Energy Systems (henceforth – local specialists).

The International Consultant will work under the supervision of the Expertise France Team Leader of the Moldovan Green Transition Technical Assistance Facility project and in close coordination with the delegated representatives of the National Agency for Energy Regulation of the Republic of Moldova.

Required profile

-    Education: University degree in engineering, economics, law or other relevant field;
-    Skills: Strong analytical skills, excellent communication and stakeholder engagement abilities. Fluent in English. Romanian and/or Russian language proficiency would be an asset;
-    Minimum Experience: Candidates must possess at least seven (7) years of relevant international professional experience in the field of energy;
-    Consultancy Experience: Previous consultancy roles that required strategic planning, study development and/or EU acquis transposition. Experience working with international agencies or projects funded by international donors will be considered an asset.
-    Sector Knowledge: Deep understanding of the EU internal market for electricity. Familiarity with the Moldovan energy sector's regulatory and market environments would be advantageous.

    Note: the international consultant will be entitled to the Expertise France standard travel to duty station fees to be paid additionally to the daily rates, subject to prior approval.
    It is not necessary to include it in the financial proposal.
