Description de la mission

Under the leadership of the overall project manager and in close cooperation with Expertise France’s Headquarter, the selected Expert will contribute to the implementation of activities of the intervention area 2 “Property mapping, property valuation, property record automation and property information management”. The selected Expert will lead the implementation of the following activities:

Sub-Task 2.2: Complete an inventory of existing paper-based property and tax records in the four cities

The Consultant work will: (i) complete a comprehensive review of each City Councils’ land records and information to understand extent of existing paper-based property inventory and volume of work to be done; (ii) identify and classify records; and (iii) compile a complete and thorough inventory of the City Rates records at each city. The Consultant will convene meetings with relevant agencies responsible for with access to geospatial database that cover the city area to determine its usefulness in developing a georeferenced digital property map, including the Ministry of Lands (Department of Physical Planning for layout plans, and Survey Department), Malawi Housing Corporation (MHC), Airport Development Limited, Press Properties, utility agencies/authorities bodies (Water Boards, ESCOM and Telecom Networks) and Malawi Communications Regulatory Authority and others to identify gaps in completing an inventory of existing paper-based property and tax records.

Sub-task 2.5: Develop a cost-effective mass property valuation for tax assessment methodology

The Consultant will design and fully develop a modern, simplified, automated and cost-effective mass property valuation methodology to be used for City Rates assessment which seeks to attain fairness and equity in the distribution of the tax burden, will support voluntary compliance and can be implemented in a cost-effective and efficient mass approach. The methodology developed in this Sub-task will be used in the design/development of the property assessment campaigns in Sub-task 2.8 and implemented as part of the City Implementation Plans.

Sub-Task 2.6: Develop a training program on the mass property valuation for tax assessment methodology

The Consultant will develop a training program and training materials/presentations on the mass property valuation for tax assessment methodology developed in Sub-Task 2.5 including identifying the objectives, timelines and phases, sessions and timeline of the training.

Sub-task 2.7: Develop and present a Valuation Methodology Workshop with the Land Economy Board 

The Consultant will: (i) develop a plan and implement a valuation methodology workshop on the cost-effective mass property assessment methodology designed in Sub-task 2.5, as well as various models for determining the value of properties and various approaches for carrying out property valuation campaigns for City Rates assessment purposes on a massive scale (Automated Valuation Methods (AVM) and mass appraisal approaches); (ii) prepare workshop technical materials and agenda for the sessions; (iii) define workshop purpose and goals; and (iii) work with the City Councils, MCA-Malawi II and the Ministry of Lands to determine participants (up-to 50 participants from City Councils, Ministry of Lands, Land Economy Board/ Surveyor Institute of Malawi, academia and other relevant stakeholders), choose a location, prepare and deliver invitations to the workshop and manage registration.

Sub-task 2.8: Design of Property Assessment Campaign Implementation Plans for each city 

The Consultant will fully design detailed plans for carrying out property assessment campaigns for each city using the modern, simplified, automated and cost-effective mass property valuation methodology developed in Sub-task 2.5. It is expected that the Consultant will work in direct collaboration with the City Councils to take into consideration the information from the existing valuation rolls of each city and the data presented in Table 9 to divide the geographic area of the cities into feasible work zones and prepare a detailed Plan with programmatic timelines for completing the campaigns in each city. At minimum the Plan will include: (i) identification of resources needed (number and types of expert-level and technician-level specialist, mobilization and computer equipment and software to be used); (ii) the process and forms/templates for technical field data collection; (iii) office data processing and quality control and assurance methods to be used; (ii) recruitment and training of enumerators-data collectors; (iii) designing and conducting awareness/sensitization/engagement mechanisms related to on-site property visits for data collection; (iv) maps and expected number and types of properties per work zone, schedules and targets for completing the work zones and clusters of properties for enumerators; (v) schedule of public review process; and (vi) the schedule of approval process at City Council. The Consultant will ensure that the property assessment campaigns are developed in close collaboration with international Social and Behavioral Change personnel and is consistent with the overall Social and Behavioral Change strategy and specific Social and Behavioral Change interventions.

Assignment

1.     Prepare a property assessment technical and operational manual using the Computer Assisted Mass Appraisal Methodology developed under Sub-task 2.5 of the Base Period. Preparation of the manual includes: (i) compile and comprehensively translate the real property appraisal and assessment parameters defined under the Local Government Acts into procedural details; (ii) develop clear and uniform guidelines in the classification, appraisal and assessment of real property for taxation purposes; and (iii) develop provisions that blend the automated mass appraisal and assessment to attain fairness and equity in the distribution of the tax burden and able to enlighten taxpayers and incentivize voluntary compliance

2.     Using the mass valuation/assessment methodology developed in the Base Period, complete property discovery and property assessment campaigns in each city for a total of approximately 275,000 properties in the four cities as presented in the following Table 9 (the number of properties has been estimated upward by 64% to take into consideration properties that will be discovered during the valuation/assessment campaigns).

Background information

Expertise France operates in more than 100 countries, implementing more than 500 projects. The agency works in close collaboration with French public institutions, as well as with the European Union, in order to respond to the needs of partner countries.

General context related to the assignment

The City Council Land-based Revenue Modernization project will be implemented in the framework of the Malawi Millennium Development Trust(MMD). MDD was established as a successor institution to Millennium Challenge Account (Malawi) MCA. MMD was established initially to supervise the completion of all outstanding works under the first Malawi Compact (Compact I). Following Malawi's selection as an eligible country to develop a new MCC compact in December 2018, the Government of Malawi designated MMD to oversee the development of this second Compact.

The objective of the City Council Land-based Revenue Modernization project is to provide support to four city councils of Lilongwe, Blantyre, Mzuzu and Zomba to implement the City Council Revenue Modernization Activity.

The four intervention areas are: (i) legal, regulatory and procedural transformation; (ii) property mapping, property valuation, property record automation and property information management; (iii) institutional and social behavior change (SBC); and (iv) budget and expenditure management support. Additionally, there is a general Task to support overall planning, reporting implementation and transfer of knowledge.

The practical purpose of the City Council Land-based Revenue Modernization project is to increase land-based revenue at each of the four City Councils. It seeks to ensure that property taxes (“City Rates”) are based on complete, up-to-date, and equitable property assessments for taxation purposes. Given the current socioeconomic circumstances, historic inequities, lack of adequate policies and enforcement and weaknesses in property data and management systems, implementing new property tax rates understandably needs to be implemented over time, with the overall strategy and implementation consistent with global practice.

Therefore, the focus of the City Council Land-based Revenue Modernization project is:

·         dedicating City Councils to City Rate modernization efforts;

·         rationalizing tax rates to be based on market rates;

·         broadening the land revenue base by identifying missing/new properties and updating the assessment of property values;

·         developing effective enforcement processes and mechanisms;

·         and increasing the effectiveness of revenue management, public financial management and the use of revenues.

It is important to note that property tax modernization efforts are only accepted by taxpayers, successful and sustainable if the revenue gained is used to improve publicly provided goods and services and that the use of the revenue is publicized and transparent to City Rate payers. In this regard, along with legal and regulatory support, technical property mapping, assessment and information systems and public financial management support – activities to remove barriers and provide a supportive environment for on-time payment of city rates through institutional and social behavior change interventions at the institutional and individual level will play a critical role in the overall success of the CCRM Activity.

Currently, the City Councils mobilize exceptionally low levels of land-based revenues, and improvements to revenue policy, regulations, procedures, and systems represent a significant opportunity to boost revenues and, in turn, use the increased revenue on expenditures to improve the provision of public services, including land administration services. Studies during the design phase demonstrated that only between 20 and 40 percent of property owners pay their City Rates among the four cities. The reasons for the low level of compliance by taxpayers and sub-optimal management by City Councils are complex, but they are attributed mainly to:

·         a significant proportion of properties not included on the tax rolls;

·         low and outdated property valuations (assessments);

·         lack of information systems for managing property information and for supporting effective billing, collection and management of taxes;

·         lack of policies, bylaws, and regulations to enforce payment compliance; and

·         lack of property owner/taxpayer awareness to requirement to pay, purpose of payment and procedures for payment, billing and accounting errors including delivery of bills and receipts, and the poor quality and/or lack of corresponding improvement in public infrastructure and public services.

Profil souhaité

The contractor is required to have following set of expertise:

·         University degree in Real Estate, Land Administration, Estate Management, Land Economics or other related field

·         Ten years of experience working on similar projects and issues in emerging economies

·         Experience in leading overall management and coordination of property valuations (assessment) related to land-based revenues and property taxation in the land administration sector.

·         Experience in leading, designing, testing and implementation of an automated valuation methods and computer assisted mass appraisal approaches

·         Experience in leading city-wide valuation campaigns ensuring application of data and evidence in adherence to the rating law, in the sub-Saharan Africa region

·         Prior experience on donor-funded technical assistance programs

·         Speaking and written fluency in English;

·         Demonstrated diplomacy and cultural awareness;

·         Teamwork and collaboration skills 

·         Certified member of an international land valuation association is an advantage.
